2017-11-10M.S.Ramachandra Rao2 pages

THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.37785 of 2017 ORDER:

Petitioner's grievance is that she has got land in survey Nos.61, 64/2, 65/2, 66/2, 4/5 and 4/6 of Kampasagar village, Miryalaguda Revenue Mandal of Nalgonda District and that the notice dt.10.10.2017 issued by the 3rd respondent seems to suggest that the respondents want to deprive the petitioner of this land.

2.

A reading of the said notice makes it clear that respondents intend to correct the revenue records only as regards survey No.66/1 of the said village, which admittedly does not belong to the petitioner.

3.

The Government Pleaders appearing for Revenue and Irrigation state that the respondents have no intention to touch the lands of the petitioner mentioned in the above survey numbers and since the land in survey No.66/1 does not belong to the petitioner, he cannot have any objection if the revenue records are rectified as regards the said survey number.

4.

In this view of the matter, the notice dt.10.10.2017 issued by the 3rd respondent in respect of the land in survey No.66/1 does not suffer from any infirmity and that the petitioner had no cause of action to file the Writ petition.

5.

The Writ Petition is accordingly dismissed. No costs. 6.

Consequently, miscellaneous petitions, pending if any, shall stand closed.
