HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16038 OF 2015 ORDER:

With the consent of learned counsel for the petitioners and learned standing counsel for third respondent-Municipality, this writ petition is disposed of at the admission stage.

2. This writ petition is filed by the petitioners apprehending demolition of their houses by the third respondent-Municipality for widening of the road. Road markings are made on the compound wall of the buildings, to the extent of which demolition required to be made. No notice was issued nor procedure as contemplated by law was followed for acquiring the properties of the petitioners for widening the road. All the properties of the petitioners are private owned properties.

3. Learned standing counsel, on instructions, submits that respondent municipality shall follow due process of law before taking action of demolition of the private properties.

4. Having regard to the said submissions, the writ petition is disposed of directing the respondent municipality to follow due process of law before acquiring the properties of the petitioners for the purpose of widening of the

road passing through the properties of the petitioners situated in Anangapal Street, 22nd Ward, Kovvur Municipality, West Godavari District. Miscellaneous petitions if any pending in the writ petition shall stand closed. ____________________________ JUSTICE P.NAVEEN RAO Note:
