This Court made the following :
ORDER:
Heard learned counsel for petitioners and learned Government Pleader for Civil Supplies, for respondents 1 to 4. The petitioners are employees of the Orugallu District Co-operative Marketing Society Limited, Warangal (for short 'the Society'), 5th respondent herein. It appears in the year 2000, the Society sustained losses. At that stage, the Society offered the employees that, whoever voluntarily resigns from the employment of the Society, they would be considered for appointment as Commission Agents to the Fair Price Shops owned by the Society. The resolution passed by the Society to that extent was accepted by the District Collector (Civil Supplies), who is the Chairperson of the Society. Accordingly, the petitioners, who are appointed as Commission Agents, have been running the Fair Price Shops.
As the petitioners have no other source of livelihood and that they have been discharging the functions of the Commission Agents of the Fair Price Shops for long time, they have requested the Government to appoint them on regular basis as Fair Price Shop Dealers. In consideration of the request made by the ex-employees of the 5th respondent society, Government issued orders in G.O.Ms. No.17, dated 08.08.2017, according permission to appoint 22 persons listed therein as Fair Price Shop Dealers against the Fair Price Shops allotted to each of them. Alleging inaction in complying with the Government orders, and selectively appointing some persons and denying appointments to the petitioners as Fair Price Shop Dealers, this Writ Petition is filed.
The Revenue Divisional Officer, Warangal (Urban), 2nd respondent herein, vide his letter, dated 17.12.2018, addressed to the Government Pleader for Civil Supplies, informed the learned Government Pleader that the petitioners would be appointed as Fair Price Shop Dealers within a period of two (2) weeks.
Recording the said undertaking of the Revenue Divisional Officer, the Writ Petition is disposed of. However, it is needless to observe that the Revenue Divisional Officer, shall comply with his undertaking, subject to compliance of all the requirements, and take suitable steps for implementation of the orders in G.O.Ms. No.17, dated 08.08.2017. In consequence, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs. _____________________ P. NAVEEN RAO, J Date: 20-12-2018.
