ORDER

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 3.

This writ petition is filed seeking to declare the action of the 2nd respondent in not considering the application of the petitioner for appointment as fair price shop dealer, on compassionate grounds, in terms of G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.2.2014, as arbitrary and illegal.

The mother of the petitioner was a dealer of fair price shop No.6, Holagunda (Village & Mandal), Kurnool District and died on 25.2.2014 and the father of the petitioner also died. Petitioner is the only legal heir of the deceased dealer. Though the petitioner was married, her husband deserted her and subsequently obtained divorce on 5.5.2013. While so, the petitioner submitted an application to the 3rd respondent on 29.07.2014 for consideration of her case as per G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.2.2014. The petitioner came to know that though the 3rd respondent sent report to the 2nd respondent on 26.11.2014, no action has been taken so far. Hence, the present writ petition has been filed. Though the learned Government Pleader for Civil Supplies was given time for getting instructions, so far no instructions have been received.

In the circumstances, the Writ Petition is disposed of

directing the 2nd respondent to consider the application of the petitioner dated 29.07.2014 seeking appointment on compassionate grounds in terms of G.O.Ms.No. 4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.2.2014, within a period of one month from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
