THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8990 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief: "To issue a Writ or order preferably in the nature of Writ of Mandamus and declare the action of the Respondents in not promoting the petitioners as Deputy Executive Engineers with effect from the date they are eligible and entitled as contrary to law and consequently direct the Respondents to immediately promote the Petitioners as Deputy Executive Engineers with retrospective effect with all consequential benefits like arrears of pay, seniority, etc., and pass such other order."

2. Heard Sri K. Lakshmi Narasimha, learned counsel for the petitioners, and Sri P. Appaiah Sharma, learned Standing Counsel for respondent No.1, apart from perusing the material placed before the Court.

3. When the matter is called, it is represented by the learned counsel for the writ petitioners that the petitioners may be permitted to make representations before the respondents and the same may be directed to be disposed of, in accordance with law, by fixing some timeframe. The said request is not opposed by the other side.

4. For the aforesaid reasons, this writ petition is disposed of, permitting the petitioners herein to submit representations before the respondents for their grievance within a period of two months from the date of receipt of a copy of this order, and if such representations are submitted within the time stipulated, the same may be considered and appropriate orders be passed, in accordance with law, within a period of two months thereafter. No order as to costs.

5. Miscellaneous petitions pending consideration, if any, in the writ petition, shall stand closed in consequence.
