THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CIVIL REVISION PETITION No. 6535 of 2018 ORDER:
1) Aggrieved by the order, dated 05.09.2018 passed in I.A.No.996 of 2018 in A.S.No.179 of 2018 on the file of the I Additional District Judge, Guntur, wherein an application filed to stay all further proceedings including execution petition in O.S.No.51 of 2016 on the file of the II Additional Senior Civil Judge (FTC), Guntur, was dismissed, the present Civil Revision Petition came to be filed under Article 227 of the Constitution of India. 2) Though various grounds are raised, learned counsel for the petitioner would submit that if reasonable time is given, the petitioner would pay the entire arrears of rent, pending disposal of the appeal suit.
3) Learned counsel for the respondents would submit that already the petitioner has violated the order passed by the trial Court, as such no further sympathy be shown to the petitioner. 4) It is stated by both the counsel that out of the total amount of Rs.3,12,500/ -, an amount of Rs.1.00 lakh is paid and the balance amount of Rs.2,12,500/ - is to be paid. 5) Having regard to the above, the Civil Revision Petition is disposed of suspending the proceedings in O.S.No.51 of 2016 including E.P. on the file of the II Additional Senior Civil Judge (FTC), Guntur, subject to the condition of petitioner depositing
balance amount of Rs.2,12,500/ - within a period of six to seven weeks from today. In default, the stay stands vacated. It is needless to mention that the quantum of rent as directed by the Court below shall be continued to be paid within the time prescribed.
6) There shall be no order as to costs. Miscellaneous petitions, pending, if any, shall stand closed.
