SEETHARAMA MURTI WRIT PETITION NO.23823 of 2016 O R D E R: (per Hon'ble Sri Justice Sanjay Kumar) The unsuccessful applicant in OA.No.537 of 2016 on the file of the Central Administrative Tribunal, Hyderabad Bench is before this Court aggrieved by the order dated 08.06.2016 passed by the Tribunal dismissing the OA at the admission stage.

Grievance of the petitioner/applicant was that his candidature was not being considered for the post of GDS LB Peon at Samalkot pursuant to the notification dated 11.05.2016 on the ground that he was over aged. It is not in dispute that the notification dated 11.05.2016 stipulated that the candidate should be between 18 and 30 years of age as on the date of the notification. The petitioner/applicant is admittedly over aged in terms of the above stipulation. The only ground on which the petitioner sought relief was that the Superintendent of Post Offices, Kakinada Division, required the Post Master, Samalkot Head Office, to issue the recruitment notification immediately and preferably by 18.01.2016 under his letter dated 04.01.2016. Sri D. Ramakrishna, learned counsel for the petitioner/applicant, would submit that had the notification been issued by the stipulated date, 18.01.2016, his client would not have been age barred.

No mala fides have been attributed in connection with the issuance of the notification on 11.05.2016. That being so, the eligibility stipulations therein would have to be scrupulously adhered to and no candidate can seek relaxation on the ground that had the notification been issued a little earlier, he would come within the zone of eligibility. The order of the Tribunal dismissing the OA, therefore, does not warrant interference.

The Writ Petition is devoid of merit and is accordingly dismissed. Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
