HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39598 of 2018 ORDER:
1) Heard learned counsel for the petitioner, learned Government Pleader appearing for respondent No.1 and Sri N.Praveen Kumar, learned Standing Counsel for Municipality, appearing for respondent Nos.2 and 3. With their consent, the writ petition is disposed of at the admission stage. Since this Court is not going into merits of the case, the writ petition is disposed of without issuing notice to the unofficial respondents. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 and 3 in not taking any action against construction of building by respondent Nos.4 and 5, illegally in Survey No.212, situated at Pulluri Ramaiahpally, Kompally, Bhupalpally town and mandal, Jayashankar Bhupalpally District, without permission, as illegal and arbitrary.
3) At the time when the matter is taken up for hearing, learned counsel for the petitioner mainly submits that pursuant to an application made under Right to Information Act, the Municipal Commissioner, Bhupalpally, furnished information stating that no permission was granted in the said plot and that the constructions made therein are illegal. Pursuant thereto, the petitioner made a representation dated 05.07.2018, requesting the authorities to take action in accordance with law.
4) Learned Standing Counsel would submit that notices came to be issued to the unofficial respondents seeking action for the illegal constructions alleged to have been made and that steps will be taken immediately.
5) In view of the above submissions, the writ petition is disposed of directing the authorities to take steps in accordance with law, as early as possible, preferably within a period of two months from the date of receipt of a copy of the order, after hearing all the concerned. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
