This Writ Petition is filed questioning letter dated 8.10.2018 of the Tahsildar, respondent No.4 to the Revenue Divisional Officer, respondent No.3.

The substance of the letter dated 8.10.2018 is to the effect that though the petitioner was not having any land, more so, an extent of Ac.3.00 cents in Sy.No.175, she has obtained title deeds and also received amounts payable under Rhythu Bhandu Scheme without permission from the Tahsildar, with the connivance of the VRA, Thammavaram village, and hence it was recommended to cancel the pattadar pass book granted in favour of the petitioner.

It is the case of the petitioner that no notice was given to the petitioner, no opportunity was afforded to her and no enquiry was conducted with regard to the allegations made. Hence, the petitioner seeks a Writ of Mandamus to declare the action of respondent No.4 as illegal, arbitrary and contrary to law.

Heard the learned counsel for the petitioner and the learned Government Pleader.

As can be seen from the letter dated 8.10.2018, it may be noted that the same is an internal correspondence between the respondent Nos. 4 and 3 bringing out certain aspects to the notice of respondent No.3 who is the superior office to respondent No.4. It is further seen from the said letter that no action is taken against the petitioner except mentioning that action needs to be taken against the petitioner with respect to the petitioner's alleged entries in the revenue records in her favour and further receiving cheques under Rhythu Bhandu scheme, though she was not eligible to receive the same, in as much as, no order has been made against the petitioner as on the date. Hence, no relief can be granted to the petitioner at this stage. The interest of justice would be served if a direction is given to the respondent Nos. 2 to 4 not to take any coercive steps without putting the petitioner on notice and without giving an opportunity to the petitioner to put forward her case.

The Writ Petition is disposed of accordingly. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
