THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2508 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in crime No.29 of 2016 on the file of the P.S., Jubileehills, Hyderabad District, registered for the offence under Sections 408, 420, 417, 468, 471 IPC read with Section 34 IPC. Heard and perused the material.

The petitioner is working under the second respondent company. Taking advantage of the position, the petitioner, instead of developing the business of the company, misused his position by diverting the persons, who approached them for purchase of villas. Further, the petitioner obtained General Power of Attorney from the persons, who already purchased the villas, to sell the same at higher prices, thereby caused loss to the company, for his personal gains.

Considering the facts and circumstances of the case, the allegations made against the petitioner are to be investigated into by the police. The police are directed to complete the investigation without arresting the petitioner and file final report, if any, in accordance with law. The police are directed to issue notice to the petitioner for his appearance for the purpose of investigation and the petitioner is also directed to appear and cooperate with the investigating agency. The petitioner is also directed to submit an Undertaking for his future appearance for the purpose of investigation. The Criminal Petition is accordingly disposed of.
