HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39532 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Sri Chatla Madhu, learned Standing Counsel for GHMC. Since this Court is not going into merits of the case, the writ petition is disposed of at the admission stage, without giving notice to the unofficial respondent. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.1 to 5 in trying to grant permission for construction of house/compound wall in favour of respondent No.6 in respect of part of the land bearing No.21, admeasuring 233 square yards in Survey No.405, situated at Mallareddynagar, Kanajiguda, Alwal, Secunderabad, as illegal and arbitrary. 3) Though various grounds are raised, learned counsel for the petitioner would submit that the petitioner made a representation on 12.10.2018 before respondent No.

5, raising objections with regard to permissions granted to the unofficial respondent in respect of the land referred to above, but the same is not considered, till date. 4) Learned Standing Counsel would submit that since the application seeking building permission is made online and the permission is granted online, it would be difficult to find out the genuinity or otherwise of the title of the said land.

5) But, the fact of application of mind by the authority concerned while granting permission is not ruled out. Hence, objections if any raised by the petitioner vide representation dated 12.10.2018, are directed to be dealt with by the Assistant City Planner, in accordance with law, if permission is not already granted to the unofficial respondent. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
