HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39564 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 1st respondent in not considering the stay petition or revision filed by the petitioner by sending the same through registered post on 26.2.2018, against the order dated 31.1.2017, passed by the 2nd respondent, rejecting the application of the petitioner without issuing any notice, in respect of the quarry lease application for steel Grey Granite over an extent of Ac.5.00 situated at Sy.Nos.934/16 to 934/31 and 935 to 898 etc., of Konidena Village, Balikurava Mandal, Prakasam District, as illegal and arbitrary.

Though various grounds are raised, the learned counsel for the petitioner submits that though the petitioner filed a stay application along with the Revision against the order dated 31.1.2017, passed by the 2nd respondent, rejecting the application of the petitioner, without issuing any notice in respect of the quarry lease application for the subject land on 26.2.2018, the 1st respondent has not passed any orders either in the stay application or in the revision petition. Learned Government Pleader for Mines and Geology, would submit that the revision sent by the petitioner was received in the office of the 1st respondent and the 1st respondent may be directed to pass appropriate orders, in accordance with law. Having regard to the facts and circumstances of the case and since the revision and stay application filed by the petitioner are pending with the 1st respondent, suffice would it be, if a direction is given to the 1st respondent, to pass appropriate orders either in the stay application or in the revision itself.

Accordingly, the writ petition is disposed of directing the 1st respondent, to pass appropriate orders either in the stay application or in the revision dated 26.2.2018, filed by the petitioner, in accordance with law, as early as possible, preferably within a period of three weeks from the date of receipt of copy of the order. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
