HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39512 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 1st respondent in not considering the stay petition or revision sent through registered post on 10.2.2018, filed against the order of the 2nd respondent in Proceedings No.20199/R3-2/2016 dated 15.6.2017, rejecting the application of the petitioner without notice in respect of quarry lease application for colour granite over an extent of 10.00 Ha in Sy.No.1 of Darsi Village, Darsi Mandal, Prakasam District, as illegal and arbitrary.

Though various grounds are raised, the learned counsel for the petitioner submits that a direction may be given to the 1st respondent to dispose of the stay application along with the revision, sent through registered post on 10.2.2018, at the earliest. Learned Government Pleader for Mines and Geology, would submit that the petitioner never appeared before the 1st respondent in spite of notices being issued by the authorities in the revision filed by him. But, however, states that no orders are passed so far in the revision.

Having regard to the above, the writ petition is disposed of directing the petitioner to appear before the authority, before whom the revision is pending after getting the date fixed, which shall be within a period of ten days from today, in which event, the authority shall hear the petitioner and pass appropriate orders, in accordance with law, as early as possible, preferably within a period of two to six weeks thereafter. No order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
