THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.24308 OF 2015 ORDER:
Heard.
The grievance of the petitioner is limited. He states that under notice R.C.No.B/703/2015, dated 24.07.2015, the petitioner was required to appear with relevant documents pertaining to Survey No.137 of Velimikatta Village, Thorrur Mandal, Warangal District. The said notice was issued when the 4th respondent was proposing to enquire into the complaint of the 6th respondent. The petitioner submitted a detailed explanation to the said notice on 27.07.2015 along with relevant documents. So far no orders are passed by the 4th respondent. His grievance in the present Writ Petition is that without passing appropriate orders, the 4th respondent is contemplating to dispossess the petitioner and to that extent he seeks a mandamus as prayed for.
I am not inclined to accept the apprehension expressed by the petitioner inasmuch as the 4th respondent has already given a notice and the petitioner has submitted his explanation to the same and the 4th respondent is bound to consider the same and pass appropriate orders on the application of the 6th respondent after hearing all the parties.
The Writ Petition is, accordingly, disposed of directing the 4th respondent to consider the application of the 6th respondent after hearing all the parties concerned. It is however made clear that till such appropriate order is passed, the petitioner shall not be dispossessed from the subject land. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
