The petitioner was initially appointed as Village Servant and further promoted as Village Revenue Officer in the year 2009. Presently he is working at Jogipet Town, Cluster III, Andole Mandal, Sangareddy District. While he was working as Village Revenue Officer of Mardi Village of Kalher Mandal, he received a show cause notice on 04.11.2014 alleging that he made some false allegations against the Officers through mobile. He was kept under suspension by order dated 18.11.2014. Challenging the order of suspension, he filed O.A.No.6934 of 2014 and the same was disposed of on 18.02.2015 directing the authorities to complete the disciplinary proceedings initiated against him expeditiously. However, a notice was received by him asking to appear on 27.05.2015 for enquiry without issuing any charge memo.
He appeared before the Enquiry Officer on that day. Without conducting any enquiry, it appears that the enquiry authority submitted a report. The petitioner received a notice on 12.11.2015 asking him to submit his explanation as to why major punishment should not be imposed upon him on the basis of the enquiry report submitted to the disciplinary authority. It was followed by an order dated 28.11.2015 imposing the major punishment withholding three annual grade increments with cumulative effect, besides treating the period of suspension from 18.11.2014 to 28.11.2015 as not on duty.
order, the petitioner preferred an appeal to the Chief Commissioner of Land Administration on 22.12.2015 and the Chief Commissioner of Land Administration admitted the same. In spite of the appellate authority's communication to send the records connected with the case, respondent Nos.3 and 4 have not been sending the records, as a result of which, the second respondent could not dispose of the appeal. In those circumstances, challenging the order dated 28.11.2015, the present Writ Petition is filed.
In view of pendency of the appeal before the second respondent, this Court is not inclined to entertain the present Writ Petition, but directs the second respondent to dispose of the appeal as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order. Since it is alleged that respondent Nos.3 and 4 are not sending the records to the second respondent, respondent Nos.3 and 4 are directed to send the records available with them to the second respondent within a period of one month from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 09.11.2017 vs
