HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SMT JUSTICE ANIS Writ Petition No.27891 of 2016 ORDER: (per V. Ramasubramanian, J.) The petitioner, who is an aspirant, for admission to a super speciality course in Medicine for the Academic year 2016-2017 has come up with the above writ petition projecting a limited grievance as to why a self-financing Medical College affiliated to the 2nd respondent University has not been included in the seat matrix for the current year.

2. Heard Sri V.M.M. Chary, learned counsel for the petitioner.

Even according to the petitioner, the self-financing institution has been given permission by the Medical Council of India for conducting a Super Speciality Course in Urology/Genetico Urinary Surgery, with a permitted intake of one student. Since the permission is granted for the first time, it appears that the self-financing institution will be entitled to fill up the seat of its own accord under the management quota. In such a situation, unless the petitioner has already entered into a tie up with that self-financing institution, he may not get the seat even if he succeeds in the writ petition. Therefore, we think that the writ petition, which will only advance the cause of someone else other than the writ petitioner, cannot be entertained. To do so would only encourage proxy litigation.

Hence, the writ petition is dismissed. The miscellaneous petitions, if any, pending in the writ petition shall stand closed. No

costs.
