THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7572 OF 2015 ORDER:
This petition is filed by the petitioner-accused No.4 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.13 of 2002 on the file of the I Additional Special Judge for CBI Cases, Visakhapatnam.
Heard and perused the material available on record. The petitioner along with other accused is alleged to have committed the offence punishable under Section 120-B r/w Sections 420, 467, 468, 471 IPC and Sections 13(2) r/w 13(1) (D) of the P.C. Act.
It is alleged that while A1 was working as Chief Manager in SSI Finance Branch of Union Bank of India, Visakhapatnam during the period from 1988 to 1999, A2 functioned as Manager in the same period and A3 worked as Deputy manager. A1 to A3 criminally conspired among themselves and with the petitioner and other accused and got sanctioned a cash credit of Rs.52.50 lakhs and letter of credit of Rs.39 lakhs apart from term loan of Rs.2 lakhs to the petitioner on the inflated security and additional collateral securities. They forged lorry receipts and invoices submitted by the petitioner and caused wrongful loss of Rs.60,49,227/-.
Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to interfere with the proceedings in the above C.C. At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of petitioner-A4 before the trial Court is dispensed with except on the date of framing of charges, if any, and on the date of examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment in the above
C.C. The petitioner is directed to be represented by his Counsel before the trial Court on all hearing dates.
