HON'BLE SRI JUSTICE R.SUBHASH REDDY CIVIL REVISION PETITION No.2432 of 2015 ORDER :
This Civil Revision Petition, under Article 227 of the Constitution of India, is filed by the petitioners/landlords aggrieved by the order dated 15.06.2015 in I.A.No.126 of 2014 in R.C.No.279 of 2011 passed by the II Additional Rent Controller, Hyderabad, in allowing the application filed by the respondents/tenants under Order 7 Rule 5 of A.P. Buildings (Lease, Rent and Eviction) Control Rules r/w. Section 151 of C.P.C., seeking to grant leave to the petitioners to file original documents, thereby receiving the same as per the list enclosed for the purpose of marking the same in evidence of R.W.1.
2. The respondents/tenants have filed I.A.No.126 of 2014 under Order 7 Rule 5 of A.P. Buildings (Lease, Rent and Eviction) Control Rules r/w. Section 151 of C.P.C., seeking to grant leave to the petitioners to file original documents, thereby receiving the same as per the list enclosed for the purpose of marking the same in evidence of R.W.1. The Court allowed the said application through the impugned order dated 15.06.2015. Hence, the present civil revision petition.
3. Learned counsel for the petitioners/landlords contents that the documents sought to be filed by the respondents/tenants are not admissible in evidence and hence the same cannot be permitted to be received in evidence.
4. If the petitioners/landlords are having any objection with regard to the admissibility and relevancy of the documents, they can raise objection at the time of recording evidence, but there is no reason in challenging the impugned order, at this stage, granting leave to the respondents/tenants to file the documents as evidence.
5. For the aforesaid reasons, this civil revision petition is devoid of merits and is accordingly dismissed, at the admission stage. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
