THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13468 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.6 seeking grant of bail in crime No.49 of 2015 on the file of the Narayankhed Police Station, Medak District, registered for the offence under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard and perused the material available on record. The allegation against the petitioner herein is that the petitioner was found in illegal possession of dry ganja of 30 kgs. Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is falsely implicated in the case. He prays this Court to grant anticipatory bail to the petitioner. Considering the fact that the quantity of ganja, which was found in possession of petitioner/A.6 is commercial quantity and also as the petitioner is having previous cases, this Court is not inclined to grant anticipatory bail to the petitioner/A.6.
