WRIT PETITION No.15734 of 2016 ORDER:

Heard learned counsel for petitioner and Assistant Government Pleader for respondents 2 to 4.

The petitioner prays for following relief :- "... to declare the action of the respondents as illegal and arbitrary in not granting fishing rights of the Malka Cheruvu, Shameerpet Mandal, Ranga Reddy District to the petitioner Fishermen Cooperative Society and to direct the respondents to grant the fishing rights to the petitioner Fishermen Cooperative Society, to call for records; and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." At the time of hearing, counsel for petitioner draws the attention of the court to the fact that fish in Malka Cheruvu is withering away due to lack of water and if no precautionary or preventive step is taken, fish will die and the revenue that can be generated will be lost.

The Assistant Government Pleader appearing for respondents 2 to 4 submits that if the petitioner makes a representation to 2nd respondent with the above request, the 2nd respondent sends Fisheries Development Officer to the subject site and if needed all steps are taken to catch the fish and deposit the sale proceeds in separate bank account for the benefit of one or the other society. The petitioner is given liberty to make representation and on such representation being made, the 2nd respondent deputes Fisheries Development Officer for the purpose referred to above.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
