THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5430 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.9 seeking grant of anticipatory bail in connection with crime No.255 of 2015 on the file of the P.S., Malkajgiri, Cyberabad, registered for the offences under Sections 419, 420, 403, 467, 465, 466, 468, 471, 472 and 120B of IPC.

Heard.

The case of the prosecution is that A.10 prepared all fake documents including the resolution for opening the current account, authorized signature to open current account, their IDs and Photostat copies of relevant documents, which were signed by the petitioner/A.9 by way of forgery and the petitioner/A.9 is the person who forged signature on the relevant papers. Learned counsel for the petitioner/A.9 submits that the petitioner has not committed the offence alleged against him and false case has been foisted against the petitioner. He further submits that the petitioner is a law abiding citizen and is ready to comply with any of the conditions that may be imposed while granting anticipatory bail.

On perusing the complaint and the order of the Court in dismissing the bail application filed by the petitioner, this Court is of the view that it is not a fit case to grant anticipatory bail.

The criminal petition is accordingly dismissed. However, the petitioner is given liberty to surrender before the Court concerned and move an application for bail and the trial Court is directed to decide the bail application on merits.
