THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.34478 OF 2015 ORDER:
This Writ Petition is filed by the petitioners challenging the inaction of the respondents in taking action on the complaint filed by the petitioners dated 5.10.2015 and further the action of the respondent authorities in interfering with the religious activity of offering prayers at the house of the 1st petitioner. Heard both sides.
This Writ Petition is disposed of directing the respondents to consider the allegations made in the complaint of the petitioners and if they are found to be true and correct, appropriate legal action shall be taken. With regard to causing of any interference to the religious activity of offering prayers is concerned, no relief can be granted under Article 226 of the Constitution of India since the petitioner has a remedy before a Civil Court. It is needless to observe that during the course of investigation in pursuance of the complaint, the Police shall issue notice to all the concerned and examine the grievances of all the affected parties and then pass appropriate orders. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
