THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 18432 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home.

Since this Court is not entertaining the matter on merits, it may not be necessary to issue notices to the unofficial respondent.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of the third respondent and his sub-ordinate staff in summoning the petitioner to the police station and threatening him with dire consequences at the instance of the 4th respondent without there being any registration of case against him, as illegal and arbitrary.

It is the grievance of the petitioner that the police are summoning him to the police station and are subjecting him to harassment without registering any crime. He further submits that though the Human Rights Commission enquired and stated that the matter is civil in nature, but, still the police are summoning the petitioner to the police station without there being any crime registered against him. Having regard to the facts and circumstances stated above, the writ petition is disposed of directing the respondent-police not to summon the petitioner, except following due process of law.
