ORAL ORDER:

Petitioner was granted fair price shop dealership No.1346035, Kammavaripalli village, Kolimigundla mandal, Kurnool district. It appears, fair price shop dealer authorization was cancelled vide orders dated 5.5.2017. The appeal preferred by petitioner was also dismissed by order dated 18.1.2018. Aggrieved thereby, petitioner preferred revision and revision is pending consideration of the District Collector, Kurnool. This writ petition is filed challenging notification dated 19.10.2018 calling for applications to enlist fair price shop dealership for the same fair price shop on which dealership authorization was granted to petitioner and against cancellation of dealership revision is filed before the District Collector and the same is pending. 2.

When the matter is taken up, learned Government Pleader placed before this Court letter addressed by the Collector (Civil Supplies) Kurnool in Rc No. 420/2018 dated 5.11.2018 wherein he categorically stated that as revision is pending before the District Collector, Kurnool, the notification issued to fill up vacancy of Kammavaripalli village of Kolimigundla mandal is withdrawn. The letter dated 5.11.2018 is taken on record and marked as X-1.

In view of the same, cause in the writ petition does not survive and accordingly writ petition is disposed of. However, it is needless to observe that after finalization of revision pending before the District Collector, it is open to the authorities to take further course of action as warranted by law. No costs.
