THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2761 OF 2016 ORDER:
This petition is filed by the petitioner under Section 482 Cr.P.C. seeking to quash the proceedings against him in FIR No.20 of 2016 on the file of Vanasthalipuram Police Station, Cyberabad, registered for the offence punishable under Sections 447 and 427 IPC. It is alleged that the petitioner criminally trespassed into the land of the 2nd respondent and demolished the compound wall and the room.
Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief sought by the petitioner.
At this stage, the learned Counsel for the petitioner submitted that due to pendency of the above crime, the petitioner apprehends arrest and harassment in the hands of the 1st respondent-police. In view of the above submission, the petitioner is directed to surrender before the investigating officer on or before 16th March, 2016 and on such surrender, the petitioner shall be released on bail on condition of his executing a personal bond for a sum of Rs.1,000/- (Rupees One Thousand only) with one surety for the like sum to the satisfaction of the investigating officer. The 1st respondent-police are directed to complete the investigation and file a final report, if any, in accordance with law.
Accordingly, the Criminal Petition is disposed of.
