Sri. Konakalla Chennaiah v. The State Of Telangana

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8100 of 2016 ORDER:

The prayer of the petitioners, two Councillors of the Municipal Council, Shadnagar Village and Mandal, Mahabubnagar District, is that the respondent authorities should act upon the resolution passed by the Municipal Council, Shadnagar, and its representation in relation to various irregularities alleged against the 4th respondent, the Commissioner of Shadnagar Municipality. Copies of the Municipal Council Resolution dated 18.02.2016 and the representation based thereon bearing the same date are placed on record. As the respondent authorities are yet to apply their mind to the afore-stated documents and take appropriate action, if warranted, this Court does not propose to entertain this writ petition at this stage for adjudication on merits.

As this Court is not venturing to adjudicate any of the issues raised on merits, it is not necessary to put the unofficial respondent on notice.

The writ petition is accordingly disposed of directing the respondent authorities concerned to consider the representation made by the Municipal Council, Shadnagar, in the light of its resolution and take appropriate action in the matter in accordance with law, if warranted. Needless to state, in the course of this exercise the respondent authorities are bound to give due notice and opportunity of hearing to the 4th respondent. This exercise shall be completed expeditiously and in any event not later than eight (8) weeks from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
