HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.37241 of 2017 ORDER:
Heard Sri V.Ashok Ram for petitioners and the Assistant Government Pleader for School Education.
The petitioners challenge proceedings Rc .No.1742/ B2/ 2017 dated 28.08.2017 of 2nd respondent refusing to change the name of School run by petitioners and the operative portion of the order reads thus :- " Further the District Educational Officer, Medchal District is also informed that again in the reference 4th cited, this office has requested to submit certain information. But till date no information was received from your end. Therefore, the proposals for change of school name in respect of Sri Megha High School, Anand Bagh, Malkajgiri, Medchal District to Krishnaveni School are herewith rejected and returned to the District Educational officer, Medchal District for taking further necessary action in the matter." The Government Pleader, after taking note of the decision making process of 2nd respondent, in stead of keeping the writ petition pending in this Court, submits that the proceedings impugned in the writ petition can be set aside and the matter may be remitted to 2nd respondent for c onsideration and disposal in accordance with law.
The statement is placed on record and accepted.
The proceeding Rc.No.1742/ B2/ 2017, dated 28.08.2017, is set aside and the matter is remitted to 2nd respondent. After perusing the reasons recorded by the 2nd respondent, this Court is compelled to take note of the helplessness recorded by the 2nd respondent in receiving information from 3rd respondent. The use of expression by this Court ought to be properly appreciated by the 2nd respondent in discharging supervisory and administrative control the 2nd respondent has over 3rd respondent in this behalf.
The writ petition is ordered as indicated above. No order as to costs.
