THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2287 OF 2016 ORDER:

This petition is filed by the petitioners-A1 and A2 under Section 482 Cr.P.C. seeking to quash the proceedings against them in FIR No.91 of 2015 on the file of Suryaraopet Police Station, Vijayawada City, registered for the offence punishable under Sections 420, 468 and 471 r/w 34 IPC.

Heard and perused the material available on record. It is alleged that the husband of the de facto complainant along with his brother-1st petitioner started business and after the death of the husband of the de facto complainant, the name of the de facto complainant was added as director. While so, her mother-in-law, sister-in-law and the 1st petitioner are trying to evict her from the house without giving her share and they are threatening to kill her. Further, petitioners 1 and 2 in collusion with the auditor, removed her from the post of Director in the company and the 1st petitioner deceitfully sent a resignation letter in her name with a malafide intention. The learned Counsel for the petitioners submitted that the parties are trying to settle the issue amicably and the investigating officer in this case is the Sub-Inspector of Police, Vijayawada city, whereas without there being any jurisdiction, the Circle Inspector of Police, Suryaraopet Police Station, is calling the petitioners and harassing them in the name of investigation.

Considering the facts and circumstances of the case and the submissions made by the learned Counsel for the petitioners, the Circle Inspector of Police, Suryaraopet Police Station, Vijayawada is hereby directed not to interfere with the investigation of the SubInspector of Police, in the above crime. The investigation officer concerned is directed to complete the investigation and file the charge sheet, if any, without arresting the petitioners. The petitioners are also

directed to appear before the investigating agency as and when required and co-operate with the investigating agency. With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
