HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27962 OF 2016 ORDER:
This petition is filed for a writ of Mandamus declaring the inaction of the respondents 2 and 3 in not considering petitioner's application dated 23.06.2015 filed before the 2nd respondent and application dated 11.07.2016 filed before the 3rd respondent for correction of survey number in petitioner's pattadar pass book and title deed and other revenue records as 860 in place of 859, admeasuring Ac.8.20 guntas of Usirikayalapalli Village, Singareni mandal, Khammam District as illegal and arbitrary and for a consequential direction to the respondents 2 and 3 to consider petitioner's applications. Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Revenue produced written instructions dated 27.08.2016 stating that an appeal is filed before the Project Officer, ITDA, Bhadrachalam and Additional Agent to Government, on 15.06.2015, against the order passed by the Agency Divisional Officer, Kothagudem in LTR Case No.1/2015/Sing, dated 09.05.2015, in Survey No.860 to an extent of Ac.8.20 cents and the same is under consideration. It is also stated that Bolli Veeraswamy and others filed a petition against the petitioner before the Court of Sub-Divisional Magistrate and
Special Assistant Agent to Government, Mobile Court, Bhadrachalam, and the same is pending.
In view of the above, there shall be a direction to the Project Officer, ITDA, Bhadrachalam and Additional Agent to Government, to dispose of the appeal filed against the order dated 09.05.2015 in LTR Case No.1/2015/Sing, within eight weeks from the date of receipt of a copy of this order and thereafter it is for the petitioner to make fresh application. Accordingly, the writ petition is disposed of. No order as to costs.
Office is directed to communicate this order to the Project Officer, ITDA & Additional Agent to Government, Bhadrachalam.
