Heard Sri S. Satyam Reddy, learned Senior Counsel for the Petitioners and Sri D. Prakash Reddy, learned Advocate General appearing for the respondents.
The petitioners state that they are graduates and eligible to be appointed for the post of School Assistant/ Second Grade Teacher. The Andhra Pradesh School Education Subordinate Service Rules are adopted by the Telangana State and now they are called as Telangana State School Educational Subordinate Service Rules. As per Rule 2 of the said Rules, post of School Assistant comes in Class 'C' category-I and the post of Language Pandit falls in Class-D Category-1. As per Rule 10 of the above said Rules, the unit of appointment is a revenue district. The post of School Assistant/ Language Pandit are District Level Posts. The Government of Telangana issued Telangana State Direct Recruitment for the post of Teacher Rules, 2017 governing the method of recruitment, qualifications etc., Now the respondent No.2 issued various Notifications on 21.
10.2017 for filling up of 8000 posts of School Assistants and Language Pandits. Challenging the same, the present Writ Petition is filed. Learned Senior Counsel for the petitioners submits that as per the Presidential Order dt. 01.11.
Districts though there are no posts in some districts such as Rangareddy, Nirmal, Warangal Urban, Warangal Rural, Jangaon, Suryapet, Yadadri Bhongir, Nalgonda etc., Thus, his main contention is that the present Notifications inviting applications for 31 Districts are contrary to the Presidential Order, which recognizes only 10 Districts.
Sri D. Prakash Reddy, learned Advocate General appearing for the respondents, submits that the posts given in the Notification are District Level posts and any one, who is eligible as per G.O.Ms.No.25 dt. 10.10.2017, can apply for the respective posts and there is no bar for the applicants to apply for the posts consequent to the creation of new Districts.
This Court carefully considered the submissions made by the learned counsel Senior Counsel for the petitioners and does not find any substance in the said submissions. Admittedly, the posts are District Level Posts. G.O.Ms.No.25, dt. 10.10.2017 defines a District as a Revenue District as formed/ reorganized by the State of Telangana by 11.10.2016 and consequently, respondent No.2 issued Notifications inviting applications for the post of School Assistant and Language Pandit. Each of the Notification provides reservation for the local candidates in the Rules. Since the notifications give equal opportunity to all the candidates, who are residing in the geographical areas, this Court finds no violation of any fundamental rights vested on the petitioners. The Presidential Order also does not come in the way of the present notifications as the posts are District Level Posts.
In view of the same, the present Writ Petition is dismissed of at the stage of admission.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
