THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Civil Revision Petition No.3376 of 2015 ORDER:

This revision, under Article 227 of the Constitution of India, is filed questioning the inaction of the VII Additional District Judge, Visakhapatnam, in not disposing of O.S.No.428 of 2012. Sri K.Chidambaram, Learned Counsel for the petitioners, would submit that, as the High Court has issued a Circular directing that precedence should be given to cases of senior citizens, no orders need be passed in this revision, and it would suffice if the petitioners are permitted to file an application before the Court below in this regard.

The C.R.P. is disposed of permitting the petitioners to file an

application, before the Court below, to expedite hearing of the Suit. I see no reason, however, to exercise discretion under Article 227 of the Constitution of India, to fix a time frame within which the Court below should decide the cases on its board. I have no reason to doubt that, on such an application being filed, the Court below shall consider the said application in accordance with law.
