HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 37520 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the rejection of the applications bearing Nos.11600004396, FR No.11600004397 and FR No.11600004398 vide undated and unreasoned order issued by the Fisheries Officer-7th respondent on behalf of the 1st respondent, as illegal and arbitrary and consequently to set aside the same.

Heard learned counsel for the petitioner, learned Assistant Government Pleader for Animal Husbandry for respondents 1 & 2, learned Assistant Government pleader for Fisheries for respondents 3 to 7 and Sri A.Giridhar Rao, learned counsel for 8th respondent.

Admittedly, petitioner has alternate remedy of appeal against impugned proceedings under G.O.Ms.No.15, dated 26.05.2015 and same is not disputed by the learned counsel for the petitioner. However, learned counsel for the petitioner submits that since malafides are attributed to the respondents, the writ petition should be entertained. Since the petitioner has alternate remedy of appeal against impugned proceedings in terms of G.O.Ms.No.15, dated 26.05.2015, this Court is not inclined to entertain the writ petition.

Accordingly, this writ petition is disposed of granting liberty to the writ petitioner to avail alternate remedy of appeal under G.O.Ms.No.15 Animal Husbandry, Dairy Development and Fisheries Department, dated 26.05.2015, if he is so advised.

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
