HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39635 of 2018 ORDER:
1) Heard. Since this Court is not going into merits of the case, the writ petition is disposed of at the admission stage, without giving notice to the unofficial respondent.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 and 3 in not taking action against the illegal and unauthorized constructions made by respondent No.4 in plot No.16-2-836/23, Madhavnagar, Saidabad, Hyderabad, as illegal and arbitrary.
3) Though various grounds are raised, learned counsel for the petitioner would submit that though he made a representation dated 11.10.2018 to the Deputy Commissioner, Charminar, GHMC, Hyderabad, bringing to his notice the unauthorized constructions made in the plot referred to above, till date action has not been initiated. 4) Having regard to the above, learned Standing Counsel would submit that appropriate authority would be the Assistant Commissioner, Charminar and not the Deputy Commissioner.
5) Having regard to the above, the writ petition is disposed of directing the Deputy Commissioner, if he is otherwise competent to consider the representation dated 11.10.2018, and deal with the same, in
accordance with law, after hearing all the concerned including the unofficial respondent, as expeditiously as possible. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
