Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents 1 to

5. With their consent, the present writ petition is disposed of at the admission stage.

Since this Court is not going into the merits of the case, it may not be necessary to issue notice to respondents 6 and 7. 3.

The present writ petition came to be filed with the following prayer:

"to issue Writ or Order more particularly one in the nature of Writ of mandamus declaring the inaction of the 5th respondent in not conducting enquiry in ROR/160/06 in spite of the Orders of the Hon'ble High Court dated 04-06-2014 in W.P.No.10439 of 2007 to pass appropriate Orders and in spite of the representations dated 02-07-2014, 25-09-2014 and 17-03-2015 submitted by the petitioner to the 5th respondent to dispose of proceedings in ROR/160/06 and not disposing of the said proceedings as illegal, arbitrary and violation of provisions of A.P. Rights in Land and Pattadar Passbooks Act, 1971 and violation of principles of natural justice and violation of Article 14 of Constitution of India and consequently Direct the 5th respondent to conduct enquiry and dispose of the proceedings in ROR/160/06 in accordance with Law within the stipulated time fixed by this Hon'ble Court."

A perusal of the material placed before the Court would show that the petitioner herein filed W.P.No.10439 of 2007 challenging the order dated 08.05.2007 passed in No.D2/80/2007 on the file of the Joint Collector and Additional District Magistrate, Nizamabad, in upholding the orders dated 17.10.2006 passed in No.ROR/160/60 on the file of the Mandal Revenue Officer, Yedpalli, in issuing Form No.13(B) & 13(C) for regularisation of alleged transfer of land in Sy.No.106/3A to an extent of Ac.6.30 Gts., situated at Pocharam Village, Yedpalli Mandal, Nizamabad District. By an order dated 04.06.2014 this Court remanded the matter back to the 3rd respondent -Mandal Revenue Officer, for decision, in accordance with law.

It is said that though the matter was remanded, the 5th respondent herein has not passed any orders in spite of number of representations.

Learned Government Pleader for Revenue submits that if the said proceedings are still pending before the 5th respondent i.e., Tahsildar, Yedapally Mandal, Nizamabad District, a direction may be given to dispose of the same, in accordance with law. 7.

Having regard to the statement made, the Writ Petition is disposed of directing the 5th respondent to dispose of the proceedings in ROR/160/06 pursuant to the order dated 08.05.2007 passed by this Court in W.P.No.10439 of 2007, if not already

CPK,J WP_5428_2016 disposed of, in accordance with law, as early as possible preferably within a period of six (06) weeks from the date of receipt of a copy of this order after hearing the petitioner and also the unofficial respondents.
