HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 38017 of 2017 ORDER :
This writ petition is filed seeking writ of mandamus declaring the order issued by the 2nd respondent vide letter No.992/A/2017, dated 17.10.2017, as illegal and arbitrary and contrary to the order passed in WP No.34793 of 2013, dated 20.11.2015 and consequently to set aside the same and direct the respondents 2 to 4 to consider the applications of the petitioners for admission as members into the 4th respondent society.
The only grievance of the petitioners in this writ petition is that they have made applications to the 2nd respondent for admission as members into 4th respondent society, but 4th respondent has rejected the same vide proceedings dated 17.10.2017 only on the ground that they do not fall within the 30 categories (castes) as per G.O.Ms.No.98, Revenue Department, dated 22.01.1964.
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Fisheries.
Learned counsel for the petitioners submits that in similar circumstances, this Court has considered similar aspect in WP No.34793 of 2013 and set aside the impugned order therein vide orders dated 20.11.2015. This Court has
also considered the similar aspect in WP No.28473 of 2017 and directed the 3rd respondent therein to forward the applications of the petitioners to the 4th respondent society along with his recommendations for consideration of their applications for membership of the 4th respondent society and that it is for the 4th respondent society to take appropriate action, in accordance with law, vide orders dated 31.08.2017.
For the reasons alike in the aforesaid orders in WP Nos.34793 of 2013 and 28473 of 2017, the impugned order issued by the 2nd respondent dated 17.10.2017 is set aside and the 2nd respondent is directed to forward the applications of the petitioners along with his recommendations for consideration of their membership to the 4th respondent. Thereafter, it is for the 4th respondent to take appropriate decision in accordance with law. With the above direction, this writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
