HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4729 of 2016 ORDER:

The inaction on the part of the second respondent in not appointing the petitioner as Fair Price Shop Dealer for Shop No.1 of Medukonduru Village and Mandal, Guntur District on compassionate grounds in terms of G.O.Ms.No.4, dated 28.02.2014 is challenged in the present Writ Petition. It is the case of the petitioner that his father was appointed as Fair Price Shop Dealer for Fair Price Shop No.1 of Medi Konduru Village and while working as such, he died on 07.01.2016. It is his further case that as he is fully eligible to be appointed as Fair Price Shop Dealer on compassionate grounds in terms of G.O.Ms.No.4, dated 28.2.2014, he made a

representation to the second and third respondents to consider his case for such appointment. When no action is taken, the petitioner filed the present Writ Petition.

A similar and identical issue was raised in Writ Petition No.25082 of 2011 and batch and this Court while disposing of the aforesaid batch of Writ Petitions through order dated 09.02.2015 directed the respondent authorities to consider the cases of the petitioners therein, if not already considered, subject to their eligibility for appointment as Fair Price Shop Dealers in terms of G.O.Ms.No.4, dated 28.02.2014 and any other subsequent instructions/circulars issued by the competent authority in regard thereto.

Inasmuch as the case of the petitioner stands on the same footing, the Writ Petition is disposed of directing the respondent authorities to consider the case of the petitioner, if not already considered, subject to his eligibility for appointment as Fair Price Shop Dealer in terms of G.O.Ms.No.4, dated 28.02.2014 and any other subsequent instructions/circulars issued by the competent authority in regard thereto. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
