HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15306 OF 2016 ORDER:

The grievance of the petitioners is that their application under Section 66 of the Patent Act, 1970 for revocation of IN patent No.214436 granted to the 3rd respondent, is not being disposed of by the 1st respondent.

Heard learned counsel for the petitioner and Sri B.Narayan Reddy, learned Assistant Solicitor General appearing for the 1st respondent. Sri C.V.Mohan Reddy, learned Senior Counsel appearing for the 3rd respondent submits that in pursuance to the application submitted by the petitioners, already notices were issued on 03.05.2016 to the parties, as such, it is not correct to state that no action has been taken by the 1st respondent.

Since the only grievance of the petitioners in the writ petition is non disposal of the application filed by them, the 1st respondent is directed to dispose of the application of the petitioners in accordance with law, within a period of three months from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
