HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.39630 of 2018 ORDER:

The only grievance of the petitioner is that respondent No.4 is not submitting the survey report regarding survey stated to have been conducted on 07-10-2017 to the 6th respondent to enable him to produce the same before the Senior Civil Judge, Peddapuram in connection with FDIA.No.820 of 2015 in O.S.No.26 of 2005.

Learned Assistant Government Pleader for Revenue produced written instructions dated 17-11-2018, in which it is stated that the licensed surveyor, Jaggampeta was deputed for conducting survey of subject lands, but Mandal Surveyor, Jaggapeta is not available at that time and he is on deputation to Machilipatnam Urban Development Authority (MUDA). The licensed surveyor who deputed to attend survey work on 07-10-2018 has not conducted any survey and failed to submit the survey report. It is also stated that in the said circumstances, the Senior Civil Judge, Peddapuram has pleased to reconstitute the Advocate Commissioner in FDIA No.820 of 2015 in O.S.No.26 of 2005 to localize the lands in Sy.Nos 243/1, Ac.4-53 cents, Sy.No.244/1 Ac.2.99 cents, Sy.No.244/2 Ac.2-94 cents, Sy.No.247/2 Ac.2-57 cents and Sy.No.126/2 Ac.0-37 cents situated at Narendrapatnama Village of Jaggampeta Mandal, as the Mandal Surveyor, Jaggampeta is presently working in their office after completion

of deputation. The Mandal Surveyor report will be submitted to the Senior Civil Judge, Peddapuram.

Recording the same, the writ petition is disposed of directing the Mandal Surveyor to complete the survey if not already completed and submit a report to the Senior Civil Judge, Peddapuram. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
