O R D E R
This contempt case was instituted alleging willful disobedience to the order dated 09.07.2015 passed by this Court in W.P.M.P.No.1520 of 2015 in W.P.No.1170 of 2015. By the said order, this Court directed the Passport authorities to renew the petitioner's passport replacing the name of the biological father by substituting the
name of the step father. The allegation of the petitioner is that this was not done. The Regional Passport Officer, Secunderabad, however filed a counteraffidavit stating that the petitioner had produced two separate birth certificates and in each of them, the name of the father was shown differently. This aspect of the matter was not brought to the notice of this Court at the time of passing the interim order. The petitioner is unable to explain as to why she has two separate birth certificates, each showing a different person as her father. In the light of these contradictory birth certificates produced, the Passport authorities are justified in not proceeding further pursuant to the interim order granted by this Court. This Court therefore finds that there is no willful disobedience to the order passed by this Court warranting exercise of contempt jurisdiction. The Contempt Case is accordingly dismissed.
