C.P. Reddy Automobiles, A Registered Partnership Firm v. Madda Vijaya Kumar
HON'BLE SRI JUSTICE R.KANTHA RAO Civil Revision Petition No.1467 of 2015 Date: 03-7-2015 Between C.P. Reddy Automobiles, A Regd. Partnership Firm, Rep. by its Managing Partner Ch.N.G.S. Prasada Reddy ... Petitioner/ Petitioner/Plaintiff and Madda Vijaya Kumar and 3 others ... Respondents/ Respondents/Defendants 1 to 4 M/s. Shriram City Union Finance Ltd., Rajahmundry, Rep. by its Manager, Two Wheeler Loans Division, Aryapuram, Opp. Kalavathi Kalyana Mandapam, Rajahmundry ... Respondent/Respondent/ Proposed Defendant No.5 HON'BLE SRI JUSTICE R.KANTHA RAO Civil Revision Petition No.1467 of 2015 Order:
Heard Sri Challa Dhanamjaya, learned counsel appearing for the petitioner.
2. The proposed party is the employer of the 1st defendant. The plaintiff alleged misappropriation of funds by the 1st defendant. It is not stated in the plaint that the proposed party misappropriated any amounts.
The learned trial Court therefore rightly held that the proposed party is not a necessary party since without his presence effective and complete adjudication can be made.
3. I see no reason to interfere with the order passed by the learned trial Court. Hence, the civil revision petition is dismissed. The miscellaneous petitions, if any, pending in this revision shall stand closed. No costs.
