THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.3567 of 2016 ORDER:
This Civil Revision Petition is filed challenging the nondisposal of I.A. No.174 of 2012 in O.S. No.124 of 2012 on the file of Principal Junior Civil Judge, Addanki, in spite of filing counter by the petitioner herein.
The petitioner herein is the defendant in O.S.No.124 of 2012 and the suit is filed for permanent injunction. The trial Court granted ad-interim injunction and the petitioner herein filed a counter in I.A.No.174 of 2012 way back on 27.03.2012. In spite of filing counter, the case is being adjourned without disposing of I.A.No.174 of 2012 finally. In those circumstances, the present Civil Revision Petition was filed.
In view of the nature of relief sought for in the present Civil Revision Petition, issuance of notice to the respondents is not necessary.
In view of the filing of counter by petitioner herein in I.A.No.174 of 2012 and in view of pendency of the said I.A., after granting ad-interim injunction, for the last four years, this Court is inclined to dispose of this Civil Revision Petition by directing the learned Principal Junior Civil Judge, Addanki to hear both the parties and dispose of I.A. No.174 of 2012 finally within a period of three (3) months from the date of receipt of a copy of this order. Accordingly, this Civil Revision Petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
