THE HON'BLE SRI JUSTICE A. RAJASEKHAR REDDY C.R.P.No.587 of 2015 ORDER:

This civil revision petition is filed challenging the order dated 29.01.2015 passed in I.A.No.641 of 2014 in F.C.O.P.No.286 of 2011 by the Judge, Family Court-cum-VI Additional District Court, Nellore, dismissing the application filed by the petitioners for issuance of summons to witness and for production of record of respondent's mother, viz., Chandrakala.

Heard learned counsel for the petitioners.

The main O.P. was filed by the respondent for custody of the ward who is in the custody of the petitioners. The present application was filed by the petitioners herein when the matter was posted for respondent's evidence. The sum and substance of the petition is to summon the Medical Department to cause production of certificate and report relating to the condition of the respondent's mother Chandralekha, on whose retirement on medical grounds the respondent has secured job by misleading the Government authorities stating that his mother is suffering with incurable illness. The trial Court dismissed the said application by observing that the petition is silent with regard to the descriptive particulars of the witness and the Doctor. The trial Court also observed that the documents, which are sought to be summoned, are no way concerned for deciding the issue in the present O.P.

As rightly held by the trial Court the petition is vague and no such petition can be entertained. The trial Court is also right in holding that the documents sought for the purpose of summoning, have no relevance to the issue in the O.P. The revision petition is misconceived. It is filed only to satisfy the personal egos of the petitioners. I see no merit in the revision petition and the same is liable to be dismissed.

Accordingly, the Civil Revision Petition is dismissed. However, the trial Court is directed to dispose of the O.P. itself within a period of six months from the date of receipt of a copy of this order. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed. ____________________________ A. RAJASEKHAR REDDY, J.
