O R D E R

The plaintiff filed the suit for recovery of the amount and during the stage of trial, based on the affidavit filed of the plaintiff under Section 139 of C.P.C., the defendant was issued notice to furnish security for the suit amount and as he failed to furnish security, by the impugned notice dated 24.4.2015, he was restrained from transferring or alienating the suit schedule property and the case was posted for hearing to 1.5.2015. Challenging the same, the present revision is filed. This court did not grant any stay of the proceedings and the hearing date given by the court below had elapsed long back and today, there is no representation for the petitioner to appraise the court the stage of the suit and in that view of the matter, the revision petition is liable to be dismissed.

The revision is accordingly dismissed. No costs. Miscellaneous petitions pending if any, shall stand closed. AVS -------------------------------- ---- 08-09-2015
