Heard the learned counsel for the petitioner and the learned Government Pleader for Higher Education (T.S.) and the learned Government Pleader for Services (T.S.) appearing for the respective respondents. 2.

The petitioner was appointed as Record Assistant on 01.11.1996 on compassionate grounds as her husband died in harness while working as Lecturer in Aided College viz., CSI Junior College, Nizamabad. She has put in more than twenty years of service by now. While the petitioner was working in Keshav Memorial Junior College, Narayanguda, Hyderabad, she was imposed a punishment of postponement of annual increment for one year without cumulative effect and the period of suspension from 18.02.2011 to 23.03.2011 was treated as extraordinary leave without pay, by order, dated 22.03.2011, passed by the Secretary and Correspondent of the said College. Thereafter, by proceedings, dated 27.02.2016, she was transferred to the fourth respondent College and accordingly, she joined and has been working therein.

While so, due to her health problems, she could not attend to office from 04.09.2017 onwards and has sent representation, dated 27.09.2017, to the second respondent seeking voluntary retirement and on 09.10.2017, she has applied for medical leave from 04.09.2017 to 04.10.2017. In the meanwhile, the Principal of the fourth respondent College sent a message to the petitioner regarding her transfer orders on 23.09.2017 at 11.05 a.m., which was noticed by her on 27.09.2017 at 4.38 p.m. As her representation, dated 27.09.2017, is not being considered and no orders thereon have been passed by the second respondent, the petitioner has filed the present writ petition.

The learned counsel for the petitioner submits that the petitioner's health is not good and she is in a position to discharge her duties and therefore, she sought for voluntary retirement by filing representation, dated 27.09.2017.

In view of the above facts and circumstances of the case, since the petitioner's representation, dated 27.09.2013, seeking voluntary retirement is pending before the second respondent, the Writ Petition is disposed of directing the second respondent to consider the said representation and pass appropriate orders thereon, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. 5.

As a sequel to disposal of the writ petition, W.P.M.P.No.45168 of 2017 filed by the petitioner for interim relief shall stand disposed of as infructuous. __________________________________ A.RAMALI NGESWARA RAO, J 04th December, 2017 GHN
