THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.2447 of 2015 ORDER:

The petitioners are the plaintiffs in O.S.No.159 of 2007. They filed the said suit for partition of A, B and C schedule properties into 384 equal shares and allot 9/384th share to each of the plaintiffs by metes and bounds. When the suit was not disposed of even after four years, the present Civil Revision Petition is filed.

A perusal of the proceedings show that it was adjourned for two years for trial and ultimately it took six months for framing the issues. After framing the issues in the month of June, 2014, the proceedings sheet indicates that the case was again posted for trial and the cross examination of the petitioner

is going on. Respondent Nos.1 to 8 were already set ex parte in the suit and only three defendants are contesting the suit. Since this is a suit for partition and three defendants are contesting, the trial Court - I Additional Senior Civil Judge, Mahabubnagar, shall endeavour to complete the trial as expeditiously as possible and dispose of the suit in accordance with law, on or before 30.04.2016. The Civil Revision Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
