When the matter is taken up, written instructions furnished by the Assistant Director of Mines & Geology, Khammam have been placed on record by the learned Government Pleader. In the said instructions, it is stated that the subject Tractor and Trailer was seized vide panchanama conducted on 06.10.2017 and the police registered F.I.R.No.296/2017 on the even day under Section 379 IPC and Section 21 of the Mines and Minerals (Regulation and Development) Act, 1957 and, subsequently, submitted to the Court of Special Mobile Judicial First Class Magistrate, Khammam.

In view of the above, giving liberty to the petitioner herein to file appropriate application before the Court of Special Mobile Judicial First Class Magistrate, Khammam, the Writ Petition stands closed.

Miscellaneous petitions, if any, shall also stand closed. There shall be no order as to costs.
