HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7692 of 2015 ORDER :

This criminal petition is filed by the petitioner/appellant to modify the order dated 23.06.2015 passed in Crl.M.P.No.122 of 2015 in Criminal Appeal No.478 of 2015 on the file of the learned IV Additional District and Sessions Judge, R.R. District at L.B.Nagar.

2. Heard learned counsel for the petitioner as well as the 2nd respondent.

3. The order of the lower appellate Court, while suspending the sentence of imprisonment with compensation in Crl.M.P.No.122 of 2015 pending Criminal Appeal No.478 of 2015, to pay or deposit 1/4th of the compensation amount, is modified to 1/8th amount following the guidelines of Apex Court expression in Dilip S. Dahanukar v. Kotak Mahindra Co. Ltd. & another[1]. The complainant is permitted to withdraw the same subject to furnishing of security.

4. Accordingly, the criminal petition is disposed of.

5. Miscellaneous petitions pending, if any, shall stand closed.
