Heard learned counsel for the petitioner, learned Government Pleader for Mines and Geology (Telangana) appearing for respondent No.1, learned Government Pleader for Revenue (Telangana) appearing for respondent No.2 and the learned Government Pleader for Home (Telangana) appearing for respondent No.3.

When the matter is taken up, it is submitted by the learned Government Pleader for Home, on instructions, that on 16.10.2016, the Gadwal police registered a case in Crime No.262 of 2016 for the offences under Section 379 I.P.C. and Section 3 of the Prevention of Damage to Public Property Act, 1984 and on the same day, a notice under Section 41-A(i) Cr.P.C. was issued to the petitioner. It is further submitted that the petitioner's vehicle was deposited before the Additional Judicial First Class Magistrate, Gadwal and as per the orders of the Court, the said vehicle was kept at the police station under safe custody. It is further submitted that after completion of investigation, charge sheet was filed before the Additional Judicial First Class Magistrate, Gadwal vide C.C.No.135 of 2017 and the same is pending trial. 3.

In view of the same, it is open for the petitioner herein to make necessary application before the Additional Judicial First Class Magistrate, Gadwal for release of the seized vehicle in accordance with law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
