THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.37102 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "to declare the action of the Respondents in not permitting the vehicles carrying sand from the State of Maharashtra into the State of Telangana as being illegal, arbitrary, irrational, without authority of law and in violation of Article 301 of the Constitution of India and consequently restrain the Respondents from interfering with the transportation of sand by the Petitioner from the State of Maharashtra into the State of Telangana through Kaleswaram Village, Mahadevpur Mandal, Jayashankar Bhoopalapally District."

I have heard the submissions of the learned counsel for the petitioner, learned Government Pleader for Mines appearing for respondent Nos.1 & 5, learned Government Pleader for Revenue appearing for respondent Nos.2 to 4, Sri V. Pratap Reddy, learned Standing Counsel appearing for respondent Nos.6 & 7 and of the learned Government Pleader for Home appearing for respondent Nos.8 & 9. I have perused the material record.

At the hearing, learned counsel on record for the afore-stated parties stated that the issue involved in the present writ petition is squarely covered by the orders of this Court, dated 20.06.2012, in W.P.No.17322 of 2012 and that, therefore, this writ petition can be disposed of on same lines.

Having regard to the facts and submissions and for the reasons alike, as were mentioned in the afore-stated orders and on the same

MSRM, J W.P.No.37102 of 2017 terms, this Writ Petition is disposed of directing the respondents not to intercept the vehicles of the petitioner transporting sand from the State of Maharashtra into the State of Telangana through Kaleswaram Village, Mahadevpur Mandal, Jayashankar Bhoopalapally District, provided that the vehicles carry the necessary permits, vehicular documents and all other documents necessary for transporting the sand and other documents disclosing payment of taxes/dues by the vehicle owners.

There shall be no order as to costs.
