HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.9037 of 2014 ORDER : (Per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed with the prayer, which reads as under:
"For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ of mandamus, declaring the action of the respondents 1 to 3 in not releasing the power tariff reimbursements already sanctioned in favour of the petitioner as informed by the 3rd respondent through his Letters Lr.No.1774/A1/2009, dated 25.01.2014 and 31.01.2014 respectively, though the petitioner was treated as sick unit and though the 4th respondent-bank is proceeding against the petitioner under the provisions of SARFAESI Act and possession notice was already issued to the petitioner on 27.01.2014 as illegal, arbitrary, unjust and unconstitutional and consequently direct the respondents 1 to 3 to forthwith release the power tariff reimbursements already sanctioned in favour of the petitioner and pass such other and further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
In this writ petition filed in the month of March, 2014, it is the grievance of the petitioner that certain amounts, which were sanctioned towards power tariff reimbursement, were not
being credited to the loan account of the petitioner by the 4th respondent.
When the matter is called for hearing, it is brought to the notice of this Court that entire amount due, towards power tariff reimbursement was already released and credited to the loan account of the petitioner by the 4th respondent. In that view of the matter, nothing survives for adjudication in this writ petition. Accordingly, the writ petition is dismissed. No order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
